Why am I being consulted?
Hackney Council is consulting with all Licensed Street Traders across the Borough over proposed changes to the standard Markets and Street Trading Conditions (MSTC).
Please ensure that you have read this consultation summary and enclosed proposals and are familiar with them before providing any feedback.
Why are the changes being proposed?
The on-going sustainability of Hackney’s vibrant markets and street trading scene is dependent on the Council’s ability to proactively manage
and develop this, supported by a current and comprehensive set of MSTC.
Having last been amended in March 2018, we are now proposing
to update these as:
• They do not reflect current professional market management requirements.
• They do not cover current legislation adequately, particularly Health & Safety
and Food Hygiene.
• Due to the different natures of the various markets, it is more difficult for some traders to comply with the existing terms than others, It is essential to have a standard set of conditions that it is fair, transparent and
practical for all traders to comply with on all markets.
As part of the statutory consultation process, the Council would like to hear your views on the proposed changes to the conditions so that these can be considered before any revised terms are implemented.
What changes are we proposing?
The proposed conditions have been developed with the various Traders Associations across Hackney's Markets and have been revised taking into account the different trading conditions and arrangements for each of them.
To help you make informed representations around the proposed changes, a copy of both the existing and proposed terms are included within this consultation pack, with areas of change highlighted in the proposed terms
document.
Separate copies of the existing and proposed terms are available on request from your local markets office.
Drop In Sessions
Should you wish to discuss the proposals with Council Officers before providing your feedback then we will be holding a series of drop-in events during the consultation period, details of which can be found below.
In addition to the drop-in sessions, you can visit the market office during opening hours to discuss any remaining queries that you may have directly wih market officers.
What happens next?
Subject to consideration of any representations received, a formal decision to implement any revised conditions will be made by the Council’s cabinet following the consultation. It is anticipated that, subject to approval, the revised conditions would take effect from 01 April 2020, with all traders being notified at least one month in advance of their implementation.
